Welcome to Dibbs, a platform that connects users with local deals from businesses. Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the Dibbs mobile application (the “App”) and www.thedibbsapp.com operated by Dibbs (“us”, “we”, or “our”).
By accessing or using the App and Website, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App or Website.
1. Use of the Service
- You must be at least 18 years old to use the App or Website. By agreeing to these Terms, you confirm that you are at least 18 years of age.
- The App and Website allow users to view, claim, and redeem deals from participating businesses. The terms for each deal are governed by the business offering it, and we are not responsible for any disputes that arise between you and any participating business.
- You agree to use the App and Website in accordance with these Terms and applicable laws. You will not use the App or Website for any unlawful purposes, including but not limited to unauthorized access, distribution of harmful content, or violation of intellectual property rights.
2. Accounts
- To access certain features, you may be required to create an account. You agree to provide accurate, complete, and up-to-date information during the registration process.
- You are responsible for safeguarding your account credentials and agree not to share your username or password with others. You must notify us immediately of any unauthorized access or use of your account.
3. Purchases and Payments
- The App or Website may offer features that allow you to purchase or redeem offers. The details of these offers are subject to the terms set by the business.
- Payments, if applicable, will be processed through third-party payment providers. You agree to abide by any terms set forth by those providers and are responsible for any associated fees or charges.
4. Business Listings and Deals
- Dibbs does not guarantee the availability, quality, or accuracy of deals listed on the platform. Deals are offered by third-party businesses, and the terms for redeeming these deals are solely between the business and the user.
- We are not responsible for disputes or issues related to the redemption of deals, including but not limited to the accuracy of the offer, quality of the products or services, or any damage resulting from the use of these services.
5. Intellectual Property
- The App and Website and all of their original content (excluding content provided by users or third parties), features, and functionality are and will remain the exclusive property of Dibbs and its licensors.
- You agree not to copy, reproduce, distribute, or create derivative works of any content provided through the App or Website without prior written permission from Dibbs.
6. User-Generated Content
- If you upload or submit content through the App or Website, you grant Dibbs a non-exclusive, worldwide, royalty-free, perpetual license to use, modify, publish, and display such content.
- You are solely responsible for any content you provide, and you agree not to upload any unlawful, defamatory, or offensive content.
7. Termination
- We reserve the right to suspend or terminate your access to the App or Website at any time, without prior notice, for conduct that violates these Terms or is otherwise harmful to Dibbs or other users.
- Upon termination, your right to use the App and Website will immediately cease.
8. Limitation of Liability
- To the fullest extent permitted by law, Dibbs, its affiliates, and its licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or use, incurred by you or any third party, whether in an action in contract or tort, arising from your use of the App or Website.
- Dibbs makes no warranty regarding the availability, accuracy, or reliability of the content provided on the App or Website.
9. Governing Law
- These Terms shall be governed and construed in accordance with the laws of United States, without regard to its conflict of law provisions.
10. Changes to Terms
- We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the “Effective Date” at the top of these Terms. Your continued use of the App or Website after such changes constitutes your acceptance of the new Terms.
